What is the difference between relationship property and separate property?

When it comes to living together being clear about what is relationship property and what is separate property is important.

The difference between the two types of property is that relationship property is all the property acquired by either partner during a relationship.  This can include your home, cars, household furniture, appliances, KiwiSaver and money in bank accounts.

Separate property can be property that was owned before the relationship began, such as inheritances and gifts from others, including from a trust.  However, it is important to be aware that separate property can become relationship property in certain circumstances including if it is used for a relationship purpose.

If you and your partner were to separate after living together for more than three years, then all relationship property will be divided equally between you.  Separate property can be retained by the partner who is the owner of the separate property.
